Attorney Eric Baker recently published an article in the National Association of Dealer Counsel, Defender: Importing U.S. Domestic Autos Sold in Canada into the U.S.: Yes, that’s a thing! The article explains federal regulation of importing and reselling used import vehicles in the U.S., which has dramatically increased in recent years. Most used vehicle imports intended for resale in the U.S. flow through registered importers. In addition to providing specific documentation that should travel with the vehicle, the registered importer must affix a sticker to the driver’s side door or pillar indicating that the vehicle has been modified to conform to U.S. Safety standards.

Dealers should be on the lookout for incoming trades and other used inventory that may have crossed into the U.S. other than through registered importers, and should also closely inspect documentation accompanying vehicles imported through registered importers to confirm authenticity. Dealers accepting used import vehicles for resale should also be aware of any state-level requirements for consumer disclosures and nuances in titling and registering such vehicles.
